The Supreme Court today quashed the Court of Appeal order which held at the Impeachment Inquiry Report presented against the former Chief Justice Shirani Bandaranaike was null and void.
The Appeals Court which considered a petition filed by Shirani Bandaranaike during the impeachment period examined the impeachment allegations and declared it null and void.
A five-judge bench of the Supreme Court headed by Saleem Marsoof which examined a petition filed by the Attorney General against this verdict unanimously decided today to quash the Court of Appeal Order.
The Supreme Court also ruled that the Appeals Court had no authority to issue orders to a Parliamentary Select Committee. The other members of the five judge bench which ruled that the Court of Appeal had no jurisdiction to pronounce upon the decision of Parliament were Chandra Ekanayake, Sathya Hettige, Eva Wanasundara and Rohini Marasinghe.
